Hospitals are vicariously liable for the actions of their employees. This includes all hospital workers in the hospital with the exception of the doctors who contract independently with the Province of British Columbia. In order to avoid liability, hospitals must have adequate policies and protocols in place to make sure patients in the hospital are safe. If hospitals don’t have adequate policies and procedures in place, they can be liable for the harm that is caused as a result.
