Doctors are required to inform their patients of the risks associated with a procedure

Even if doctors have not done anything that falls below the standard of care, they are required to inform their patients of the risks associated with a procedure and obtain informed consent before proceeding. If they fail to obtain the patent’s informed consent, and it can be shown that a reasonable person possessing the plaintiff’s particular knowledge and characteristics would have refused the procedure, then the doctor may be found responsible for a bad outcome, even if what he or she did was not negligent.
